PARTICIPANT AGREEMENT
The following sets out the terms and conditions of the agreement (The “Agreement”) between the undersigned (“Participant”) and 13334007 Canada Inc., carrying on business as First Class Leaders (“First Class”) with respect to the Navigating Leadership in the Cockpit course (the “Course”).
1. Course Content and Use: The Course content is extracted from credible sources but is intended as guidance only. It is subject to interpretation and based on the latest research available at the time of creation. First Class endeavours to keep the course content current, but there may be instances where newer research or information is not included.
2. Intellectual Property: The materials provided by First Class are for personal use by Participant only. Copying, sharing, or using these materials for any purpose without written consent from First Class is prohibited.
3. Consent for Sharing DiSC Profiles: As part of the collaborative learning process, Participant consents to sharing Participant’s DiSC profiles with other members who have taken the Course. Participant’s consent extends only to sharing of DiSC profiles during Course activities.
4. Payment and Class Reservation: Each Course is limited to a maximum of 12 participants to ensure a quality learning experience. To secure a place in the Course payment is required upon registration. No place in the Course will be reserved until payment is received by First Class.
5. Refund Policy: All payments are fully refundable up to five business days before the scheduled Course date. Refund requests made within five business days of the Course start date are non-refundable, except in exceptional circumstances at the sole discretion of First Class Leaders. Approval of such requests is not guaranteed and will be evaluated on a case-by-case basis.

6. Liability: The information and strategies provided as part of the Course and on the First Class website are to be used as a supplement to Participant’s professional judgment. First Class is not responsible for the interpretation or application of the Course content by Participant in any personal or professional decision.
7. Partial Validity: If any provision(s) of this Agreement are held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any manner.
8. Law Governing Agreement: This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario.
9. Forum For Disputes: The courts of the province of Ontario shall have exclusive jurisdiction over the resolution of any dispute, controversy or claim arising out of or in relation to this Agreement.
10. Assignability: This Agreement shall not be assignable by the Participant but may be assigned by First Class to another company qualified to provide the Course.
11. Complete Agreement: This Agreement represents the complete understanding of the parties with respect to the Course.
12: Waiver: No waiver of any provision(s) of this Agreement shall be deemed, or shall constitute, a waiver of any other provisions, whether or not similar, nor shall any waiver constitute a continuing waiver.
Agreement to Terms
By signing the registration form for the workshop “Navigating Leadership in the Flight Deck,” the Participant agrees to all of the above provisions.
